XIX.-XX. Yüzyıl Hive Hanlığı Kadı Sicilleri Kataloğunda Yer Alan Kesin Satış Senetlerinin Değerlendirilmesi

Abstract

Documents belonging to the Khanate of Khivaare among the most important sources for understanding the khanate’s administrative structure, legal system, diplomatic relations, and socio-economic order. These documents include diplomatic correspondence, land registers, waqf deeds, tax records, and qadi records. They are important in reflecting the state’s institutional functioning and administrative approach. the Qadi records hold a privileged position due to the detailed data they provide on legal practices, daily life, property relations, and social structure. They contain documents on subjects such as irrevocable sales, mortgage sales, waivers of lawsuits, endowments, inheritance, marriage, wills, the appointment of guardians, powers of attorney, debt relations, slave sales, and emancipation. The language and style of the documents point to the existence of a developed legal language tradition, characterized by specific patterns and established terminology. This paper focuses on irrevocable sale documents found in the 2001 publication Katalog Hivinskih kaziyskih dokumentov ХIХ - naçala ХХ vv (Catalog of Khiva Khanate qadi records from the 19th century to the beginning of the 20th century). Referred to in the catalog as “beyᶜ-i bât”, “beyᶜ-i bâtât” or “beyᶜ-i katᶜî”, these documents constitute the largest group of documents in the work. They record the purchase and sale of various properties, including land, houses, shops, stalls, and craft workshops. This paper transcribes and evaluates facsimiles of the irrevocable sale documents included in the catalog in terms of content, style, and legal terminology.
